Success: PGWP + Restoration approved
We cannot, of course, publish all our successes on our website. We receive too many positive decisions to announce each result. We recently published another Work Permit that was approved. Today, however, we were successful with a particularly difficult case. This was a file that we agreed to reluctantly. Very complex immigration history. This client had been working with another professional and, based on our review, that Consultant prepared a shoddy application that led to a refusal. In many cases, we are retained to fix a mess from poor advice or poor representation. In this case, we discussed a potential complaint against the RCIC who prepared the PGWP that was refused. We worked with our client to build the strongest possible package – and we won! WOOT!
Here is a brief history of the file:
- 2016 – Client entered Canada and received Study Permit
- 2021 – graduated from DLI
- Client was part-time student for 5 academic semesters
- Client hired Immigration Consultant (licenced RCIC) to submit PGWP
- PGWP Refused
- Client was distraught, frustrated and lost. He had to stop working and was supported financially by friends and family.
- 2022 – Client contacted CIL, shortly before the expiry of his Restoration Period
- Team members worked with Client to build package and prepare supporting documentation.
- Drafted explanation from part-time studies, including a letter from an Academic Advisor from the University of Manitoba.
- 2023 – PGWP and Restoration approved
No one wants their application refused. In this case, our client gave $$$ to a member of his community to help. He trusted the RCIC who, unfortunately, did not prepare a strong application. He trusted an Academic Advisor from the University of Manitoba who told him the (many!) VWs on his transcript would be fine. They were wrong.
I have to be honest. I was not sure we could put together a package strong enough to get a new PWGP. We talked to our client about possibly filing a complaint against the RCIC who prepared the first application. The main point is the RCIC was not incompetent. Our client was a part-time student for many semesters during his studies. That was the main reason for the refusal. The RCIC’s inability to draft a good explanation for our client is not a good reason for a complaint.
We will continue to work with our client and guide him to PR status. We love positive results!
